1. Acceptance of Terms
By accessing flexfitarizona.com, booking a session, purchasing a package, or engaging with any FlexFit Arizona service, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use our website or services.
2. Services Offered
FlexFit Arizona provides concierge personal training, assisted stretching, therapeutic recovery, and TPI-backed golf performance coaching to clients in the Phoenix, Arizona area. Services are delivered in-home, at private studios, or at gym locations as agreed upon at the time of booking.
We also offer online nutrition habit consultations via video call. These consultations are focused on general wellness habits and goal-setting and do not constitute medical or clinical nutrition advice.
Service availability, pricing, and offerings are subject to change at our discretion. Current pricing is displayed on our website at the time of booking.
3. Eligibility
Our services are intended for individuals 18 years of age or older. By booking a session or using our website, you represent that you are at least 18 years old. Clients under 18 may only participate with written consent from a parent or legal guardian, who assumes full responsibility for the minor's participation.
4. Health and Medical Disclaimer
FlexFit Arizona provides fitness, movement, and recovery services for general wellness purposes. We are not a medical provider. Nothing on our website or in our sessions constitutes medical advice, diagnosis, or treatment.
You are responsible for consulting with a licensed physician or healthcare provider before beginning any new fitness or physical activity program, particularly if you:
- Have a known medical condition, injury, or chronic illness
- Are pregnant or postpartum
- Have recently undergone surgery or a medical procedure
- Experience pain, dizziness, or discomfort during physical activity
Health information provided through our intake forms is used solely to inform session planning and ensure your safety. It does not replace professional medical evaluation.
5. Assumption of Risk and Liability Waiver
Physical activity involves inherent risks including, but not limited to, muscle soreness, strain, injury, or aggravation of pre-existing conditions. By participating in any FlexFit Arizona service, you voluntarily assume all such risks.
You agree that FlexFit Arizona, its founder Darien Rico, and any associated trainers or practitioners are not liable for any injury, loss, or damage — whether direct, indirect, or consequential — arising from your participation in our services, except in cases of gross negligence or willful misconduct.
You represent that you have disclosed all relevant health conditions, injuries, and physical limitations through your intake form or verbal communication prior to your session.
6. Bookings, Cancellations, and Payments
Booking
Sessions are booked through our scheduling platform (Acuity Scheduling). A booking is confirmed upon receipt of payment or a confirmed appointment notification. By booking, you agree to arrive on time and prepared for your session.
Cancellation Policy
We require a minimum of 24 hours notice to cancel or reschedule a session. Cancellations made with less than 24 hours notice may result in forfeiture of the session or a cancellation fee, at our discretion. No-shows without notice will be charged in full.
FlexFit Arizona reserves the right to cancel or reschedule sessions due to illness, emergency, or circumstances outside our control. In such cases, we will notify you as early as possible and reschedule at no additional cost.
Payments
Payment is processed through Square and/or Squarespace at the time of booking or as otherwise agreed. All prices are listed in U.S. dollars. We accept major credit and debit cards. Session packages and monthly memberships are non-refundable unless otherwise agreed in writing.
Package and Membership Terms
Session packages must be used within the agreed timeframe. Unused sessions in a package do not roll over beyond the expiration date unless a written extension is granted. Monthly memberships renew automatically unless cancelled in writing at least 7 days before the next billing cycle.
7. Client Conduct
We are committed to providing a professional, respectful, and safe environment for all clients. You agree to:
- Treat FlexFit Arizona staff with respect at all times
- Disclose any health changes or new injuries before each session
- Follow reasonable instructions provided by your trainer during sessions
- Not attend sessions while ill, intoxicated, or otherwise impaired
- Respect the property of any location used for sessions
FlexFit Arizona reserves the right to terminate services immediately and without refund if a client engages in abusive, threatening, or inappropriate behavior.
8. Intellectual Property
All content on flexfitarizona.com — including text, images, service descriptions, training programs, and branding — is the property of FlexFit Arizona and protected by applicable copyright and intellectual property laws.
You may not reproduce, distribute, modify, or use any content from this website for commercial purposes without our prior written permission. Personal, non-commercial use for reference is permitted.
9. Website Use and Disclaimer
We make reasonable efforts to keep the information on our website accurate and up to date, but we make no warranties regarding the completeness, accuracy, or reliability of any content on the site.
Our website may contain links to third-party websites (such as scheduling or payment platforms). We are not responsible for the content, privacy practices, or terms of any third-party site. Visiting those links is at your own discretion.
We reserve the right to modify, suspend, or discontinue any part of our website or services at any time without notice.
10. Limitation of Liability
To the fullest extent permitted by applicable law, FlexFit Arizona and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services — including but not limited to personal injury, property damage, loss of data, or loss of revenue.
Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid to us in the 30 days preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless FlexFit Arizona and its founder from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of our services, your violation of these Terms, or your misrepresentation of any health information provided to us.
12. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.

We may update these Terms of Use from time to time. The "Last updated" date at the top of this page reflects when the most recent changes were made. Continued use of our website or services after any changes constitutes your acceptance of the updated terms. For material changes, we will notify active clients via email.
